Supreme Court Upholds Birthright Citizenship, Blocking a Key Trump Administration Policy on Citizenship by Birth

The US Supreme Court has struck down an executive order by President Trump that aimed to limit birthright citizenship for children of undocumented immigrants and temporary foreign visitors. The 6-3 ruling reaffirms the constitutional principle that nearly all children born on US soil are citizens.

Chief Justice John G. Roberts Jr. wrote that the executive order violated a right enshrined in the 14th Amendment, stating that children born in the US to undocumented or temporary residents are citizens at birth. He emphasized that citizenship is the right to participate freely in the political community, a promise extended by the framers of the 14th Amendment.

The chief justice was joined by the court's three liberal justices and two fellow conservatives, Justices Amy Coney Barrett and Brett M. Kavanaugh, in upholding birthright citizenship. Justice Kavanaugh based his decision on federal law, rather than the Constitution. The ruling deals a significant blow to a policy President Trump has pursued for over a decade.
